What Are The Penalties For DWI?
Commercial license DWI
· A person holding a commercial driver’s license may be charged with DWI for a blood alcohol content of .04%. He/She does not necessarily have to be driving a commercial vehicle at the time of the arrest. A DWI conviction means an automatic revocation of a commercial driver’s license.
DUI (Driving Under the Influence for a person under age 21), Class C misdemeanor
- Up to $500 in fines, probation and community service, and driver’s license suspension of up to a year.
First Offense DWI, Class B misdemeanor
- Up to a $2000 fine, 180 days in jail, mandatory alcohol-education classes, and suspension of driver’s license. (Though the person may qualify for an occupational drivers’ license)
Second Offense DWI, Class A misdemeanor
- Up to a $4000 fine, up to a year in jail, community service for a regulated time period and extended suspension of driver’s license.
Third Offense, Third Degree Felony
- Possible consequences include fines of up to $10,000, up to 10 years in prison, possible community service, prolonged suspension of driver’s license suspension, and the installation of an ignition interlock device in the vehicle. In-patient substance abuse treatment may also ordered by the court, an extended probation upon successful completion of alcohol education and a mandatory prescription.
Intoxication Assault, Third Degree Felony
- Up to a $10,000 fine, prison time of up to 10 years, possible community service and a prolonged suspension of driver’s license.
Intoxication manslaughter, Second Degree Felony
- Up to a $10,000 fine, prison time of a minimum of 2 to no more than 20 years, community service or alcohol education classes and permanent revocation of driver’s license.
